Cayman Islands substantial business presence residency in 2026

The Residency Certificate (Substantial Business Presence) is a specialised route for certain business owners and senior managers. It is not a generic startup visa.

Who can fit the statutory route

The section 50 framework distinguishes two broad cases:

  • a person who owns, directly or indirectly, at least 10% of the shares in an approved category of business through which substantial business presence is established; or
  • a person employed in a senior management capacity in an approved category of business.

Approved categories are prescribed by regulation and include specified financial-services and other business types. Applicants should check the current list rather than assume any ordinary company qualifies.

What counts as substantial presence

The current regulations direct WORC to consider whether the business has a physical Cayman presence through the purchase or lease of commercial real estate and employs at least four full-time employees who are legally and ordinarily resident in the Islands for at least nine months in the calendar year.

Current annual-declaration rules also require the certificate holder to confirm at least 90 days' physical presence in Cayman in the preceding calendar year and that the relevant business continues to exist.

Residence and approved work

The underlying statutory certificate is valid for 25 years, renewable at the Director of WORC's discretion. It allows the holder to reside in Cayman and work in the qualifying business in the approved occupation.

But the certificate does not itself grant every corporate or commercial licence. Trade and Business Licensing and Local Companies (Control) requirements remain separate.

Compare with direct investment

An investor who is placing at least CI$1,000,000 into an employment-generating business should also compare the Certificate of Direct Investment. The two routes have different qualifying tests.
