Peru Permanent Residence in 2026
Peru's general Permanente residente category gives indefinite residence after the required legal-residence history. It is not the only permanent pathway in Peru: MERCOSUR and Andean residents have their own regional conversion rules, and family cases can have distinct consequences.
General three-year route
Migraciones' current general procedure says a foreign national who has lived in Peru for three consecutive years as a worker, investor, researcher or member of a religious community can request the change to Permanent resident, subject to the detailed conditions.
The Migration Law likewise describes the general Permanent category as indefinite residence after three years as a legal resident.
Do not automatically apply this page's three-year rule to every immigration category. Treaty, regional or family rules can create different permanent or indefinite outcomes.
Absence condition
For the qualifying three-year period, Migraciones states that the applicant generally must not have been outside Peru for more than 183 consecutive calendar days within a 365-day period, unless the person holds the relevant authorization to stay outside the country.
Residence-history planning therefore depends not just on the date a status was granted but also on travel history and any authorized absence.
Procedure and current fee
The application is made through Migraciones' digital system. The official page currently publishes a S/162.50 fee and a 30-business-day response period. The page also includes current notes about legal decisions affecting representation and Interpol-related administrative requirements, so applicants should read the live page rather than relying on an old checklist.
Indefinite residence and the identity card
Permanent status is indefinite. However, permanent immigration status and the Carné de Extranjería are not the same thing.
Migraciones clarified in February 2026 that people with Permanent status do not file periodic residence extensions, but they still renew the Carné de Extranjería. The current guidance gives the permanent-resident card a five-year validity period for adults, with a different period for minors.
MERCOSUR and Andean permanent routes
A holder of two-year MERCOSUR Residence follows the MERCOSUR conversion procedure within the prescribed pre-expiry window rather than waiting for this general three-year route.
Likewise, qualifying Andean Residence holders use the permanent Andean procedure tied to their temporary Andean status.
Naturalization is separate — and the rule is in transition
Migraciones' current online naturalization procedure still says a foreign adult with at least two consecutive years of legal residence may apply for Peruvian nationality, according to the applicable immigration status and subject to all other conditions.
However, Peru enacted Ley 32421, Nueva Ley de Nacionalidad, in August 2025. Its naturalization provisions would raise the minimum residence period to five continuous and immediately preceding years and add other requirements. Migraciones subsequently ran public consultation on the implementing regulation, and 2026 government material states that the new law had not yet entered into force while that implementation remained pending.
Accordingly, as verified on 7 October 2026, ReloTide treats the two-year Migraciones procedure as the currently operational rule, while flagging the enacted five-year replacement as a material upcoming change. Anyone close to applying should re-check the live Migraciones procedure and the effective status of Ley 32421 before relying on a residence timeline.
This can look surprising because the currently operational two-year nationality threshold is shorter than the three-year general Permanent-residence threshold. The reason is that permanent residence and nationality are separate legal procedures. Meeting a residence-duration threshold never grants citizenship automatically, and applicants must satisfy the full nationality requirements in force when they apply.
