Peru Family Residence in 2026
Peru's Familiar de residente category permits residence for qualifying members of the family unit of a Peruvian citizen or a foreign resident. It is both a reunification route and, importantly, a status that can permit lawful economic activity.
Qualifying family unit
The Migration Law's family-unit definition includes, subject to its precise conditions:
- a spouse or recognized de facto partner;
- minor children within the defined family unit;
- certain unmarried adult children up to age 28 who are undertaking technical or higher studies;
- certain unmarried adult children who cannot support themselves because of a duly proven physical or mental disability; and
- qualifying ascendants.
The exact relationship wording matters. Do not assume every extended relative qualifies merely because the family relationship is genuine.
Sponsor status
For an adult initial family-resident application, Migraciones requires a proven family relationship with a Peruvian national or a foreign resident in Peru. If the sponsor is a foreign resident, that person's immigration status must be regular and current. If the sponsor is Peruvian, their DNI must be current.
The initial procedure says the applicant must be outside Peru to obtain the category. Relationship documents issued abroad generally need the authentication/legalization or apostille treatment required by the procedure.
Work rights
This is not merely a dependent status with a blanket work prohibition. The Migration Law states that Familiar de residente permits lucrative activity in a subordinate or independent capacity.
Employment, tax registration, regulated-profession licensing and other sector-specific rules can still apply separately.
Duration
The law generally links the family member's stay to the resident sponsor's granted period. For family members of a Peruvian, the law provides continuing validity while the applicable extinction grounds do not arise.
Migraciones' separate child procedure illustrates how sponsor status can affect the period: it currently states two years for a minor linked to a Peruvian and one year, renewable, when linked to a foreign resident. Adult cases should be checked against the exact current procedure and relationship rather than assuming the child-period rule applies identically.
Documents and processing
The adult procedure requires passport, background evidence for relevant adults and the civil-status documents proving the specific family link. On the official page checked 7 October 2026, Migraciones publishes a S/58.80 fee and a response period of up to 30 business days.
Long-term options
Family pathways can have distinct long-term consequences depending on the sponsor and legal basis. Do not assume the general three-year Permanent Residence page is the only possible long-term rule for every family case. Peruvian nationality rules can also differ by marriage or other circumstances.
