L-1 intracompany transfer in 2026
L-1 classification is for a qualifying transfer within a multinational organization. It is not a general visa for any owner of a U.S. company.
L-1A and L-1B
L-1A covers qualifying executives and managers. L-1B covers qualifying employees with specialized knowledge.
USCIS generally requires the beneficiary to have worked abroad for a qualifying organization for at least one continuous year within the three years before the relevant U.S. transfer period, subject to the governing rules.
The U.S. petitioner and foreign employer must have a qualifying relationship, such as parent, branch, subsidiary or affiliate, and the business structure must satisfy the applicable rules.
New-office cases
L-1 can also support certain expansions where the foreign company is opening a qualifying U.S. office. New-office cases require evidence of premises, business planning, financial ability and the proposed U.S. role. For an L-1A new office, the business must be positioned to support a managerial or executive role within the required period; simply forming an LLC is not enough.
Duration and family
L-1 status is temporary and category-specific. Maximum periods differ between L-1A and L-1B, and new-office approvals can start with shorter validity.
Eligible spouses and unmarried children under 21 may seek L-2 status. USCIS recognizes qualifying L-2 spouses as employment-authorized incident to status when the admission/status documentation reflects the applicable spouse classification.
Permanent residence is separate
Some L-1A managers or executives may later fit an employment-based immigrant category, but an L-1 approval is not itself permanent residence and does not guarantee an immigrant petition.
